Hospital de Custódia e Tratamento Psiquiátrico (HCTP): instituição de ambiguidade na saúde mental brasileira

Abstract

Review’s Study exploratory and descriptive about the Hospital of Custody and Psychiatric Treatment (HCTP), as a place of ambiguity in the Brazilian mental health, with the following objectives: to characterize the (HCTP) as an institution of care for people with mental disorder perpetrators of crimes; analyzes the concept of the person with mental disorder who committed crimes and his criminal accountability; identify the fundamentals that structure the HCTP as a legal and health institution and discuss alternatives strategies to the model of HCTP to care for people with mental disorder perpetrators of crimes. The integrative review was the methodological strategy adopted with ten articles selected as a data source through literature, analyzed using thematic categorization. Among the main results, stand out some considerations: the adoption of the criminal accountability of the person with mental disorder author of crime, with the guarantee of human rights and extinguishment of security measures. Are also discuss the ambiguous profile of the institution HCTP and its legal concepts that based, as the presumed notion of dangerousness; Psychiatric Reform and its extension to HCTP and also, to a lesser extent, the public network of mental health care. As substitutive alternatives emerge, the experiences of the Comprehensive Care Program to the Judiciary Patient Carrier of Mental Suffering Offender, Minas Gerais (PAIPJ) and the Program of Integral Attention to the Crazy Offender developed in Goiás (PAILI). The fostering of debate that proposes this work is necessary for the creation of new pathways that may replace the institution in question, and thus ensure to persons with mental disorder perpetrators of the crimes recommended by the Psychiatric and human rights Reform.
