O ethos do policial civil na persecução penal (persecutio criminis in judicio) como elemento garantidor da segurança humana

Abstract

The overall objective was to describe the institutional ethos of Civil Police regarding the requirement of criminal prosecution be an element guarantor of human security. That is, studying aspects of the symbolic system within which produces not only the language that characterizes all intersubjective communication of police, as well as their cultural orientations according to which these professionals give sense and meaning to their actions, including modifying them or adjusting the demands that are conjectural. The methodology and the nature of the goals was the search for methodological procedures able to work simultaneously a range of variables, quantitative and qualitative, derived from perceptions of police officers and the meaning they attach to their dynamics within the institutional field. Such characteristics were sought in this universe ethos between different views and attitudes relating to the profession and to its activity, the police investigation. The results suggest that the Civil Police, subtly co-exist evidence in respondent's ethos two ways of behaving in the year-judicial investigative police: an initial, conservative imprint, identified with the representation of the person in conflict with the law as capable of neutralizing enemy in the face of citizenship, a second, of a more creative, which places it as a problem amenable to a redefinition complex, open to interventions weighted, and mediating institutions, the goal of rebuilding lives immersed in the criminal world. In conclusion it was observed that the civil police in the state of Bahia is an organization that still harbors pockets of outdated paradigms in criminal prosecution (persecutio criminis in judicio) prohibiting the institution be fully guarantor of human security. Two paradigms co-exist would be intending the exercise of police functions, observed through the ethos of respondents: a) those that are defined by so-called "persecutory reason" that lean toward the "arrest and prosecute criminals". Heritage of traditional morality and the criminal justice system, b) those that are defined by a police-judicial investigative tilted to the paradigm garantivista, acting in an ethical, legal and professional.
